Mass Torts

Intentional Torts

Intentional torts include assault and battery claims involving little or no injuries, as well as claims involving major injuries and death.  Intentional torts are acts of malicious or intentional infliction of harm that cause injury.  This area of law represents another busy area of Campbell, Lauter & Murphy’s defense practice.  We have eliminated claims against our clients for punitive or exemplary damages and have successfully resolved many difficult claims.  Our jury trial experience and excellent results have made Campbell, Lauter & Murphy a law firm of choice when such claims are asserted.

Intentional torts, such as assault and battery, are both criminal and civil offenses.  Our lawyers can file a civil suit to seeking monetary damages for your injuries suffered in an assault or battery.

Assault and battery cases can be

Physical Assault: A physical assault requires the infliction of pain or bodily injury upon another person during a physical attack.

Sexual Assault: Under the law, sexual assaults refer to unwanted physical contact that is sexual in nature. Sexual assaults can include:

  • Non-consensual touching
  • Rape
  • Attempted rape
  • Incest
  • Child molestation
  • Voyeurism
  • Exhibitionism
  • Sexual harassment.

Verbal assault: Some verbal threats are considered assaults. Touching the victim is not required.

Assaults can be cause serious damage and trauma.  They are often committed against women, children, and the elderly.  Assaults occur in colleges, in fistfights, and in domestic abuse situations.  One in four women will be sexually assaulted in their lives.  Police or other municipal enforcement officers can assault victims.  Hate crimes against certain populations are also assaults.

Appellate Practice

Trucking Accidents Litigation

Campbell, Lauter & Murphy has extensive experience in litigating trucking accidents.  Due to the inherent nature of a tuck’s size, most of these accidents involve serious personal injuries, as well as multiple vehicles.  We are familiar with how to mount an investigation in a trucking accident case, including checking on driver training, and driver inattention due to sleep deprivation. The firm is an active member of the Defense Research Institute's Subcommittee on Trucking Litigation.
